On 3rd June 2024, International Arbitration and Mediation Centre, Hyderabad (IAMC) and Wilmer Cutler Pickering Hale and Dorr LLP hosted a Fireside Chat between Justice Hima Kohli, Judge, Supreme Court of India and Mr. Gary Born, Partner at Wilmer Cutler Pickering Hale and Dorr LLP, titled “In Conversation with Justice Hima Kohli and Gary Born” in London, United Kingdom.
Moderated by Mr. Tariq Khan, Registrar of IAMC, Hyderabad and Ms. Shanelle Irani, Senior Associate at Wilmer Cutler Pickering Hale and Dorr LLP, the discussion delved into the difference in approaches between judges and arbitrators, highlighting the unique consideration each role entails and how their decision-making processes differ due to the nature of the respective dispute resolution mechanisms.
The moderators posed questions on the evolving legal landscape, the importance of equitable considerations, and the influence of cultural backgrounds on decision-making processes. Justice Kohli and Mr. Gary Born also shared their personal experiences and insights, offering valuable advice to junior lawyers.
Justice Hima Kohli highlighted the importance of a mentor, especially outside of court, such as how one must conduct oneself, the morality, the ethics of a lawyer while handling matters and people.
Mr. Gary Born reflecting on professional pressure stated “One of the ways you can get a little bit of respite from the immediacy of everything is to realise that balls bounce and that you’re not going to catch every ball before it hits the ground. Mistake, errors are an inevitable part of your professional career and spending a whole lot of time worrying about the mistakes you’re going to make, you’re going to make more mistakes.”
